Intel® Black Belt Software Developer Program

These rules (including the Intel Privacy Policy and the Intel Terms of Use) govern the Intel® Black Belt Software Developer program (the "program") and set out the rules between Intel Corporation and its affiliates ("Intel" or "us/we") and each developer ("developer" or "you").

  • You are eligible to participate in the program if you have registered with (1) the Intel® AtomTM Developer Program at http://appdeveloper.intel.com and/or (2) the Intel® Software Network at www.intel.com/software
  • You must speak, read and understand English and you must be aged 18 years or over or you must obtain the consent of your parents or legal guardian before you participate in the program. If you enroll for the program, if you contribute to the program or if you accept any program points, prizes or rewards, you accept these rules.
  • The program is open to developers from Intel® AtomTM Developer Program and the Intel® Software Network worldwide. All national and local laws and regulations of the developer's country of residence apply. Residents of countries under U.S. embargo are not eligible to enter. The program is void wherever else it is restricted or prohibited by law.
  • Intel provides you with access to a variety of resources on the Intel Atom Developer Program and the Intel Software Network and related documentation (the "resources").
  • We may refuse your registration and/or any of your contributions for any reason.  We may refuse to award points for a contribution for any reason.
  • Intel does not claim ownership of your personal information and your contributions, for example sample code, videos, photos, pictures, articles, white papers, text, posts, blogs, comments, ratings, contest entries.
  • By submitting your contribution, for example sample code, videos, photos, pictures, articles, white papers, text, posts, blogs, comments, ratings, contest entries, and all related submissions, you grant Intel and its affiliated companies the following worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, fully paid-up rights:
    • to publicly perform or display, import, broadcast, transmit, in whole or in part, for promotional and marketing purposes worldwide in any and all forms of media, whether now known or hereafter devised, and to distribute the contribution and related entries to Intel affiliates and its marketing agencies for these purposes, and
    • to publish your name or alias and your contribution and all related entries in connection with this program and for marketing and promotional purposes worldwide in any and all forms of media, whether now known or hereafter devised .

  • Your contributions to the program will be available to Intel and other program members. You warrant that:
    • you own or otherwise have all rights necessary for you to provide the contribution and all related entries and you grant the rights described above and you do not disclose any information which would constitute a violation of a confidentiality obligation;
    • you are the sole author and owner of the intellectual property rights thereto;
    • you have obtained the consent of all individuals shown if you upload a picture, photo or video showing another person(s);
    • all "moral rights" that you may have in such content have been voluntarily waived by you;
    • all content that you post is accurate;
    • you are at least 18 years old; and
    • use of your contribution does not violate these terms and conditions and the Intel Terms of Use and will not cause injury to any person or entity.

  • You further agree and warrant that you shall not submit any contribution:
    • that is known by you to be confidential, false, inaccurate or misleading;
    • that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
    • that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
    • that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
    • for which you were compensated or granted any consideration by any third party;
    • that includes any information that references other companies, services, products, websites, addresses, email addresses, contact information or phone numbers;
    • your contribution and all related entries do not contain any viruses, worms, spy ware, or other components or instructions that are malicious, deceptive, or designed to limit or harm the functionality of a computer; and
    • your contribution and all related entries are not subject to license terms that require any software or documentation incorporating or being derived from your entries to be licensed to others.

  • You acknowledge that you, not Intel, are responsible for the contents of your contributions. None of your contributions shall be subject to any obligation of confidence on the part of Intel, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.
  • You agree to indemnify and hold Intel (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.
  • Apart from prizes and rewards offered as part of the program, no monetary compensation will be paid for any contribution and any related program entries.
  • These rules don't apply to applications and components available on the Intel® AtomTM Developer Program. Applications and components will not be made available for download by end-users as part of this program. Developer will be able to register applications and components with the app store for that purpose.    
  • Intel is not responsible for incorrect or inaccurate member information, whether caused by you or any other persons or by any of the equipment or programming associated with or utilized in the program.
  • The membership to each of these levels is valid for 12 months from the membership start date to that level. All rewards are subject to availability and they may change at any time.     

  • Points cannot be applied to the membership level until credited to the contribution account. We are not responsible for a failure, delay or error of points to be credited. If contribution points are not credited, you may contact us by writing to us at isn.support@intel.com.
  • Points expire, if the relevant contribution account is closed or the Intel® Black Belt Software Developer program ends.
  • A Member who continues to contribute and to collect points will be able to review the membership status and the points status online in the contribution account/ user profile.
  • Points and membership status can only be earned, held, transferred or redeemed as set out in these rules. Any other use, award, sale, exchange or transfer of points or membership status, or attempt to do so, is a serious breach of these rules. Any points not earned and held in accordance with these rules will be invalid and cannot be redeemed for rewards.   

  • If you no longer meet the minimum required criteria for your current membership level, you will not re-qualify for your current membership status, and you will be re-assigned or downgraded to the appropriate qualifying tier of membership without notice. You will still be required to meet the downgraded level's requirements. Your contribution account will be updated accordingly.
  • You may be required to sign and return releases of liability, declarations of eligibility, and where lawful, publicity consent agreements, within five (5) days of acknowledged notification of prizes and rewards. If a member cannot be contacted, is ineligible (under these rules or due to a failure to comply with any of the other applicable policies, licenses, rules, and terms of service, fails to claim a prize, or fails to timely return the completed and executed releases/agreements as required), prizes and rewards may be forfeited, at Intel's discretion. Physical prizes awarded for the winning entries will be sent to developers within six (6) weeks from the date of the notification email or confirmation of the winning developer's physical address, whichever is later.
  • Prizes and rewards are personal to the developer submitting the contributions and achieving a particular membership level and cannot normally be transferred. All prizes and rewards are subject to availability and they may change at any time. Intel may award substitute prizes and rewards of equal or greater value.
  • The developer accepts responsibility for all federal, state and local taxes and fees in connection with the prizes and rewards. The developer shall be solely responsible to obtain all permissions and authorizations to collect and receive the prize in accordance with the laws of the developer's country of residence. This program is void where prohibited or restricted by law, and subject to applicable federal, state provincial and local laws. If the developer is a resident of a country in Latin America, cash prizes will be replaced by goods and/or services of equal value in Intel's sole discretion.
  • Intel does not provide any warranty on the prizes and rewards. To the fullest extent allowable by law, Intel specifically disclaims any representations or warranties, express or implied, regarding the prizes and rewards, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance.
  • We may, on notifying you, immediately suspend or terminate your membership, if you breach these rules or if we reasonably believe that you have submitted a contribution in violation of these rules.
  • Intel reserves the right, in its sole discretion, to suspend or terminate the program at any time for any reason. In this case, your contribution account will be terminated or suspended.     

  • You can withdraw your contribution at any time by notifying us. If a contribution is withdrawn your rights to a membership level benefit are lost.
  • These rules apply to your contributions, your membership level, including the benefits, and the resources, unless we provide any items to you under more specific terms, in which case those more specific terms will apply to the relevant items. We may make changes to these rules at any time without notice to you. The most current version of the rules will be provided to the developer with the invitation and it can be requested by email at any time. Contributing to the program or accepting prizes and rewards will constitute acceptance of the revised rules.
  • Our only responsibilities with respect to the Intel® Black Belt Software Developer program are set out in these rules which are subject to the laws of Delaware. We will only be liable to a member who suffers loss as a result of our breach of these rules and, if so, our sole liability will be to credit to the relevant contribution account any points which have been wrongly deducted or should have been credited but were not. These Rules prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
  • You can contact us by logging onto the Intel Software Network web-site. For any feedback on the level of your membership, the program or accumulated points participants can contact Intel by writing to us at isn.support@intel.com.
  • If Intel improperly denies you any prizes, rewards or points, Intel's entire liability and your sole and exclusive remedy will be limited to a distribution of the equivalent amount of prizes, rewards and points as set forth above. By participating in the program, you waive any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
  • Intel does not personally verify or endorse the contributions that are submitted. Intel is not responsible for the use of any contributions nor does Intel guarantee that the contribution is legally sharable, virus free, or free of errors. Under no circumstances will Intel be liable for any such contribution, including, but not limited to, any claims, errors or omissions, or damages of any kind.
  • If for any reason this program is not capable of operating as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Intel which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this program, Intel reserves the right at its sole discretion, to disqualify any individual who tampers with the entry or voting process, and to cancel, terminate, modify or suspend the program.
  • Intel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Intel is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Intel on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to developer's or any other person's computer relating to or resulting from participation in this program or downloading any materials in this program.
