Encryption validity and secure protocols SSL/TLS

Hi, I found interesting for us validation criteria in "Validation guidelines" :
SEC03 Description : Encryption and export requirements Test Steps: Check if encryption is being used Expected Results: No encryption used Notes Required to conform to encryption and export regulations

Will be programs that use SSL/TLS encryption (for example HTTS and IMAPS) stated as valid, or it is prohibited to use any encryption mechanism ? PS: Maybe it's unsupported feature now, but became valid in future. Am I right ?

This may explain the encryption regulations a bit more. I do not believe they are saying NO ENCRYPTION, they do however want it compliant with U.S. law.
