QuickSync with Windows Media Foundation gives E_FAIL when trying to create transform object

Using the activation object to create an IMFTransform does not work with QuickSync and the Windows Media Foundation classes and no obvious error is returned. How can I create a IMFTransform to perform hw-based h264 encoding on Windows 8.1
