Attention GDC attendees: Intel is giving away a free Zenbook! To enter, simply attend an Intel Perceptual Computing event and tweet a photo between Sunday 3/24 and Thursday 3/28 at 12:30PM PDT. Developers can receive up to 10 entries for qualiying tweets. We'll randomly draw a winner and announce from the @PerceptualSDK handle at 2:00 PM PDT. INTEL® Perceptual Computing DEVELOPER ULTRABOOKTM SWEEPSTAKES Official Rules

NO PURCHASE NECESSARY.  A purchase or payment will not increase your chances of winning.

1.       Eligibility

The Intel GDC Developer Ultrabook Sweepstakes (“Promotion”), is sponsored by Intel (“Sponsor”), and open to legal residents of the United States, District of Columbia, who are at least eighteen (18) years of age at the time of entry. Void outside the United States and where prohibited.

Officers, directors and employees and their immediate families (spouses, parents, siblings and children) of Intel, CMD (“Administrator”), (collectively, the “Promotion Parties”) and their respective affiliates, subsidiaries, parent companies and agencies and those living in the household of same (whether related or not) are not eligible to enter or win. By entering this Sweepstakes, entrants agree to abide by all terms of these Official Rules. All Federal, state and local rules and regulations apply. Void outside the Eligibility Area and where prohibited or restricted by law.

2.       Promotion Period

The sweepstakes begins on March 24, 2013 at 12:00 a.m. PST and ends on March 28, 2013 at 12:30 p.m. PST (“Promotion Period”).

3.       How to Enter  

To participate, you must attend the 2013 Game Developers Conference located at the Moscone Center in San Francisco, California, and tweet about Perceptual Computing, using “@PerceptualSDK” and “#IntelUB” in your tweet. Once completed, you will automatically be entered in the drawing.

You may enter up to ten (10) times per person during the Promotion Period.

Here are the ways you can enter:

  1.   If you tweet a picture and message from our Perceptual Computing Developer Day or a Perceptual Computing Talk/Theater Session, you will receive three (3) entries into the drawing.
  2. If you tweet about Perceptual Computing, you will receive one (1) entry into the drawing.

You must use “#IntelUB” and “@PerceptualSDK” in tweet in order to qualify.

You must be present on March 28, 2013 at 4:00 p.m. PST at the Intel Booth #1016, South Hall to receive your prize. Only one prize per person will be awarded during the Promotion Period.

4.       Random Drawings

One (1) winner will be randomly selected from all eligible entries received during the Promotion Period. The drawing will be held on March 28, 2013 at 2:00 p.m. PST.

5.       Prize and Odds of Winning

The winner will receive one (1) Lenovo ThinkPad Twist S230U 12.5" Touchscreen Ultrabook, previously used as a development system,   with an Approximate Retail Value (ARV) of $600.00 USD

THE TOTAL APPROXIMATE RETAIL VALUE (ARV) OF all prizes is $600.00 USD

Odd of winning depends on how many eligible entries are received.

Prize consists of only those items specifically listed as part of the prize. All prizes are awarded “as is” with no warranties, representations or guarantees, including but not limited to, quality, condition, merchantability, or fitness for a particular purpose. Winners must look to the manufacturer for any warranties or guarantees. No transfer or substitution of prizes, except by Sponsor, in the event an advertised prize is not available.  In such cases, Sponsor may substitute a prize of equal or greater value.

Winners are solely responsible for all federal, state, and local taxes and other expenses or fees associated with prize receipt and use. No substitution, assignment, or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value if prize cannot be awarded as stated for any reason. Sponsor will report taxes as required by the applicable law of Sponsor’s jurisdiction and winner’s jurisdiction.

In the event that a potential prize winner is disqualified or not authorized or eligible to receive the prize for any reason, potential winner forfeits prize, and an alternative winner may be selected.

6.       Winner Notification.

The Sweepstakes winner will be notified via tweet at 2:00 p.m. PST through the @PerceptualSDK handle.  You must be present on March 28, 2013 at 4:00 p.m. PST at the Intel Booth #1016, South Hall, to receive your prize.

The Sweepstakes winner will be required to execute and return a witnessed Affidavit of Eligibility/Release of Liability and (except where prohibited) a Publicity Release and an IRS #W-9 form. All required forms must be completed and returned in person at the time of prize delivery. Failure to return required forms in this time period will result in such winner being disqualified and subsequent drawing held to pick an alternate. Any prize notification or prize returned to Sponsor or its fulfillment company as undeliverable for any reason will be forfeited, and Sponsor shall have the option to award the prize to an alternate. All Federal, state and local taxes are sole responsibility of winners. Acceptance of a prize constitutes permission (except where prohibited) to use winner's name, likeness and statements for publicity without additional compensation or limitation. 

7.       Data Collection. Sponsor and its agencies collect personal information from you when you

  participate in the Promotion. The information collected is subject to the Sponsor’s

8.       General Conditions

        Sponsor’s computer is the official clock for purposes of participation. Sponsor reserves the right to cancel or modify the Promotion if fraud, technical failures, or any other factor beyond its control impairs the integrity of the Promotion, as determined by Sponsor in its sole discretion.

        Any attempt by any person to deliberately damage Sponsor’s or any related promotional communications or undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law, (as well as disqualifying such individual, if appropriate). Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. These Official Rules (or any other Promotion materials) may not be published elsewhere without the express written consent of Sponsor, which may be withheld for any reason.

Administrator is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Administrator or presenter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof.  If for any reason the technical portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion.  Administrator reserves the right to select winners from eligible entries received as of the termination date.  Administrators further reserve the right to disqualify any individual who tampers with the entry process. Administrator may prohibit an entrant from participating in the Promotion if it determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices or intending to abuse, threaten, or harass other entrants.  Caution: Any attempt by a participant to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Administrator reserves the right to seek damages from any such participant to the fullest extent of the law.

9.       Publicity

Except where prohibited by law, participation in the Promotion and acceptance of prize constitutes winner’s consent to the Promotion Entities’ use of winner’s name, likeness, voice, opinions, hometown, and state and other indicia of persona for promotional, trade, or advertising purposes in any media without geographic or time limitation, and without additional payment or consideration.

Release

Entrants agree that the Promotion Sponsor and Administrator (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses, or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related activity, or from entrants’ acceptance, receipt, possession, and/or use or misuse of any prize, and (B) have not made any warranty, representation, or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. The Promotion Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with the Promotion. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE PROMOTION ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT.

10.   Limitations of Liability

        The Promotion Entities are not responsible for and entrant hereby releases Sponsor, its partners, and agencies, (including but not limited to Intel and CMD), from any claims arising from: (1) incorrect or inaccurate transcription of entry information or lost, stolen, illegible, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels, all of which are void and will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware, or software; (3) the unavailability or inaccessibility of website or any other service; (4) unauthorized human intervention in any part of the entry process or the Promotion and/or incomplete or inaccurate information being displayed on website whether due to unauthorized human intervention, equipment failure, or malfunction, or other cause; (5) electronic or human error that may occur in the administration of the Promotion or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant’s computer, (or any information/materials stored thereon), which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in the Promotion or from downloading any material from Sponsor’s or related website(s), regardless of whether the material was prepared by Sponsor, agency, or a third party, and regardless of whether the material is connected to a Sponsor’s or agency’s website by a hypertext link.

11.   Disputes/Choice of Law

     Except where prohibited by law, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in the state of California, (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits may be awarded, (collectively, Special Damages), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.  California law, (with the sole exception of the choice of law/conflict of law rules of California or of any other jurisdiction), governs the Promotion and all aspects related thereto including construction, validity, interpretation, and enforceability of these Official Rules. Entrant agrees to submit to the personal and exclusive jurisdiction of the courts located in that state.
